Case Studies / Success Story:
A small grain elevator and its manager were facing approximately $15 million in forward grain contracts with farmers who refused to deliver. The client was in the middle of a complex situation involving these forward contracts hedged with futures and exacerbated by the fact that the elevator could not afford to offset the contracts. Tom’s plan was to file suit against the 10 farmers who defaulted in order to make the client whole. The farmers responded with complaints to the Commodity Future Trading Commission (CFTC), which led to an investigation of the elevator and manager. While the investigation was on-going, judgment was obtained against all 10 farmers on behalf of the elevator. The farmers appealed the ruling to the Nebraska Supreme Court. Meanwhile, the CFTC investigation culminated in an Administrative Hearing seeking to void the contracts and sanction the elevator. The Nebraska Supreme Court upheld the 10 judgments against the farmers, leading the Full Commission of the CFTC to overturn the Administrative Judge, thus, absolving the elevator and its manager.
