New Form I-9 Is Available For Employer Use

On November 14, 2016, the United States Citizenship and Immigration Services branch of the Department of Homeland Security issued a new Form I-9 for use in verifying the identity and work authorization of all new employees. It is dated 11/14/2016. Beginning on January 22, 2017, the USCIS will only accept that version of Form I-9. Until that date, employers can still use the May 8, 2013 version. The new version of Form I-9 will only be required for use with new employees and does not require employees to go back and replace previously completed I-9’s.

At this time, Form M-274 “Hndbook for Employers, Guidance for Completing Form I-9,” has not been updated to be consistent with the new Form I-9. The USCIS promises that it will be updated soon.
