One of Dave’s clients was a lender engaged in the financing of an upscale condominium project. The borrower/developer was in default, and the client was considering taking title to a number of the condo units. Dave advised the client that if they took title they could potentially be liable for certain construction defects in the condominium unit. Dave’s counsel helped the client avoid a potentially massive liability pitfall and kept them from risky litigation exposure.
