Banks, Lenders and Finance

McGrath North has a long, successful history of representing banks and other financial institutions.

Our team has a deep understanding of the opportunities and challenges faced by managers, loan officers and in-house counsel at these organizations, and that experience allows us to effectively support these lenders in a broad range of service areas. Through our work with both lenders and borrowers, this experience also crosses all of the key business segments (such as agribusiness, manufacturing, retail, energy, and many others), so we bring that invaluable, practical understanding to the table.

We know that time-to-close and completing the financing are key drivers to any finance project, and our experience working on behalf of both creditors and debtors in a wide variety of complex transactions positions us to get closings completed within the desired timeframes. We regularly handle a broad range of transactions including revolvers, term loans and asset securitization facilities, letters of credit, syndicated and participated facilities, and secured and unsecured loans. In addition, our team knows the unique challenges that must be overcome in complex layered financings such as mezzanine financing, subordination agreements, intercreditor agreements, and subsidiary and parent guarantees.

At the same time, we recognize that protecting creditors' rights is critical to both the short- and long-term performance of banks and lenders. As a result, we stay focused on turning defaults into recoveries whenever possible, and our experience also working with distressed debtors enhances achieving that success. At McGrath North, we have the experience to advise our clients' on the best strategy tailored for each unique situation which may include: loan workouts, non-judicial and judicial foreclosures, UCC sales, and the fully range of bankruptcy tools such as relief from automatic stay, litigating claims and plan confirmation, defending preference and avoidance actions, and involuntary bankruptcies.
