Mandatory Use of E-Verify By Government Contractors Further Delayed

As previously noted, the requirement that all contractors with certain government contracts sign on to and apply a modified version of the E-Verify system to verify the employment authorization of their employees, also called the “Basic Pilot” program, had been postponed until June 30, 2009. It has just been announced that the applicability of that requirement has been further extended to September 8, 2009. Accordingly, no solicitations for government contracts or subcontractors issued prior to September 8, 2009, will contain the contract clauses that the E-Verify rule would require. That rule, if put in effect, would apply to both federal contractors and subcontractors.

We will keep you advised of any further developments.
