Cody E. Brookhouser-Sisney

Attorney

Cody is an experienced litigation attorney who focuses her practice on labor and employment law, business and contracts, and commercial litigation.


Cody advises companies of all sizes on a broad spectrum of business and employment-related issues, including contractual rights and responsibilities, fiduciary obligations, non-competes, non-solicitation and employment agreements, employment policies and procedures, hiring/firing and discipline decisions, reductions in force, navigating the ADA and FMLA, wage and hour issues and compliance with federal, state and local laws. She is responsive, pragmatic and to-the-point in helping clients understand their options for the path forward.  

Cody advocates for her local, national and global clients in federal and state court and in a wide range of employment-related litigation, business torts, contractual disputes and construction litigation. Cody is also experienced in administrative proceedings before the EEOC, DOL and Office of Administrative Law Judges in defending labor and employment disputes such as discrimination/harassment investigations, wage claims, collective bargaining, contract negotiations, grievance arbitration and unfair labor practice complaints.

Cody also has in-house experience with a Fortune 500 company where she managed day-to-day employment litigation and compliance matters and gained valuable insight into providing her clients with real-world advice and solutions.

Cody earned her Juris Doctor, with High Distinction, from the University of Iowa College of Law. After law school, she served as a judicial law clerk to the Honorable Chief Justice Patience Drake Roggensack of the Wisconsin Supreme Court during the 2015-2016 term. Cody was recognized in the Best Lawyers in America: Ones to Watch listing for Employee Benefits (ERISA) Law, Litigation - Labor and Employment in the 2021-2022 rankings.

Federal Trade Commission Issues Final Rule Barring Non-Compete Agreements

On April 23, 2024, the Federal Trade Commission (FTC) held an open meeting and voted 3-2 (along party lines) to issue a Final Rule that bans post-employment non-compete agreements. According to the FTC, approximately 30 million people nationwide (1 in 5 workers in the U.S.) are bound by non-compete clauses.

DOL Releases Overtime Rule Nearly Doubling Salary Threshold Affecting Millions Of Employees

The Department of Labor (DOL) released its highly anticipated final rule regarding overtime for white collar workers. As expected, the final rule will nearly double the salary threshold for exempt workers beginning January 1, 2025, with a smaller increase beginning on July 1, 2024. The final rule also increased the salary level for the highly compensated employee exemption. Below is a table with the scheduled increases:
